1. About Tenkan

Tenkan is a digital app designed to empower users in self-reflection and personal growth. It offers journaling tools, self-care challenges, affirmations, and tracking features for mood and emotional insights. Please note that Tenkan is not a medical service, nor is it intended to provide clinical or diagnostic advice.

2. Eligibility and Parental Consent for Teen Users

Tenkan is intended for individuals aged 13 and older.

• For Users Aged 13-17: Parental or guardian consent is required to create an account. By allowing a teen to use Tenkan, parents or guardians consent to these Terms on behalf of their minor child and agree to supervise their child's use of the Service.
• For Users 18 and Older: No parental consent is required.

By using the Service, all users confirm they are either 18 or older, or between 13 and 17 and have obtained parental consent. Parents or guardians may contact us with any concerns regarding their child's account or to revoke consent at any time by emailing support@discoveryourjourney.info.

3. Subscription and Fees

Tenkan offers Monthly and Yearly subscriptions that provide access to premium features. Subscription management and payments are processed exclusively through the Apple App Store and Google Play Store, not directly by DiscoverYourJourney LLC.

Payment and Billing

• By subscribing through the app, you authorize the App Store (Google Play Store or Apple App Store) to charge your chosen payment method on a recurring basis based on the subscription plan selected.
• Subscription fees and billing terms, including any trial offers, discounts, or promotions, are subject to the terms set forth by the App Store where you purchased the subscription.

Cancellations and Refunds

• For any cancellations, refunds, or billing inquiries, please contact the App Store where you purchased the subscription.
• Cancellations must be managed directly through the Google Play Store or Apple App Store, as we do not have access to manage, modify, or cancel subscriptions on your behalf.
• Please note that cancellation will take effect at the end of the current billing period, and you may continue to use premium features until that period ends. Refunds for partial periods are subject to the App Store's policies and may not be available.

4. User Conduct

While using Tenkan, you agree not to:

• Share, post, or transmit harmful or unlawful content.
• Reproduce, distribute, or otherwise misuse Tenkan's content.
• Attempt unauthorized access to our systems or servers.

We reserve the right to terminate access for any prohibited conduct or violation of these Terms.

5. Intellectual Property

All content within Tenkan, including text, graphics, and logos, is the property of DiscoverYourJourney LLC. You are granted a limited, non-transferable license to access and use the Service for personal, non-commercial use.

6. Medical Disclaimer

Tenkan is not a licensed healthcare provider and does not offer medical, psychological, or psychiatric advice. The app's content, including journaling prompts, affirmations, and other self-reflection tools, is for informational and personal development purposes only. DiscoverYourJourney LLC does not provide medical advice or clinical care, and Tenkan should not be used as a substitute for professional mental health treatment.

7. Disclaimers and Limitation of Liability

Tenkan is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Service's accuracy, reliability, or fitness for any specific purpose.

Limitation of Liability

To the fullest extent permitted by law, DiscoverYourJourney LLC will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, emotional distress, or any other intangible loss, resulting from the use or inability to use Tenkan.

Assumption of Risk

By using Tenkan, you understand and agree to assume all risks associated with your use of the Service, including any potential emotional effects related to self-reflection and mood tracking.

8. Privacy and Data Collection

Your privacy is important to us. Tenkan's Privacy Policy explains how we collect, use, and protect your personal data. For teenage users, we collect minimal data required to provide the Service and comply with applicable privacy laws, including the Children's Online Privacy Protection Act (COPPA).

Data Handling for Teen Users (Aged 13-17)

• Parental Access and Control: Parents may review, request deletion, or restrict the data Tenkan holds for their child by contacting us at support@discoveryourjourney.info.
• Restricted Data Collection: For teen users, we limit data collection to only what is necessary for core functionality, such as journaling entries and mood tracking data.

9. Cancellation and Termination

You may cancel your subscription at any time. Upon cancellation, your access will remain until the end of the current billing period, and you will not be eligible for a refund for that period. We reserve the right to suspend or terminate your access to Tenkan if you breach these Terms or engage in prohibited conduct.

10. Dispute Resolution

By using Tenkan, you agree that any disputes will be resolved through binding arbitration rather than in court. You waive any right to participate in a class-action lawsuit. Details on dispute resolution and arbitration can be found in our full Terms.

11. Changes to Terms

We reserve the right to change or modify these Terms at any time. Any changes will be posted on our app and website. Continued use of Tenkan following such changes will indicate your acknowledgment and acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or your use of Tenkan shall be brought exclusively in the courts located within Snohomish county, WA.
